Legal Separation in New York State

When a couple realizes that their marriage is no longer working, they may want to consider their options regarding how to end the marriage. While many people choose to get a divorce, others would rather choose to become legally separated instead. There are a number of reasons that one may want to choose legal separation over divorce. Some of these reasons may include, but are not limited to the following:

  • Religious beliefs that do not support divorce
  • They wish to continue filing taxes jointly
  • One party wishes to become a foster parent

If a couple decides to become legally separated, they can draft a separation agreement. A separation agreement is quite similar to that of a divorce agreement and will address many of the same matters. Some of the factors that may be addressed in a separation agreement include child custody, child support, the division of assets and liabilities, spousal maintenance, among other things.

Separation agreements make it very easy for the couple to get divorced if they do decide to do so in the future. These separations must be signed in front of a notary public.
